Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Member," "you," or "your") and Elite Singles ("Elite Singles," "we," "us," or "our"), governing your access to and use of the Elite Singles website, mobile application, and all related services (collectively, the "Platform").

By registering an account, accessing, or using the Platform in any way, you confirm that you have read, understood, and agree to be bound by these Terms, along with our Privacy Policy, which is incorporated by reference.

1. Eligibility

To create an account and use the Platform, you must:

• Be at least 18 years of age;
• Be legally capable of entering into a binding contract in your jurisdiction;
• Not be prohibited from using online dating services by any applicable law;
• Not have previously been removed from the Platform for violation of these Terms.

By registering, you represent and warrant that you meet all of the above eligibility requirements. If you do not meet these requirements, you must not access or use the Platform.

2. Account Registration and Security

2.1 Creating Your Account

To access the full features of the Platform, you must register for an account by providing accurate, current, and complete information as prompted by the registration process. You agree to maintain and update your information to keep it accurate, current, and complete at all times.

2.2 Account Credentials

You are responsible for maintaining the confidentiality of your account credentials, including your password. You agree to notify us immediately at support if you suspect any unauthorised use of your account. We cannot be held liable for any loss or damage arising from your failure to protect your account credentials.

2.3 One Account Per Person

Each member may maintain only one active account. Creating duplicate accounts is a violation of these Terms and may result in the suspension or termination of all associated accounts.

3. Membership and Payment

3.1 Free Membership

Basic registration, profile creation, completion of the personality assessment, and receipt of daily match suggestions are provided free of charge. Certain features, including messaging and full photo access, require a Premium membership.

3.2 Premium Membership

Premium memberships are available in three durations: 3 months (Premium Light), 6 months (Premium Classic), and 12 months (Premium Comfort). All Premium memberships are charged as a single upfront payment for the full term, as detailed on our Membership page.

3.3 Automatic Renewal

Your Premium membership will automatically renew at the end of each term at the then-current rate for the same duration, unless you cancel before the renewal date. We will send a renewal reminder to your registered email address no less than seven days before any renewal. You may disable automatic renewal at any time through your account settings.

3.4 Cooling-Off Period and Refunds

In most jurisdictions, a statutory cooling-off period of 3 days applies to new Premium subscriptions. If you cancel within this period and have not made use of Premium features, you may be entitled to a full refund. After this period, or if you have used Premium features, no refund will ordinarily be issued for the remainder of a paid term, except where required by applicable consumer protection law.

3.5 Price Changes

We reserve the right to modify membership pricing at any time. Price changes will not affect any subscription period already paid for. Notice of pricing changes will be provided at least 30 days in advance via email and in-platform notification.

4. Your Conduct on the Platform

4.1 Acceptable Use

You agree to use the Platform solely for its intended purpose — to connect with other adults for genuine romantic relationships — and in compliance with all applicable laws and regulations. You agree that your profile information will be truthful, accurate, and genuinely representative of you.

4.2 Prohibited Conduct

You must not, under any circumstances:

• Create a false identity or misrepresent your identity, age, or personal circumstances;
• Post content that is abusive, harassing, threatening, defamatory, obscene, or otherwise objectionable;
• Solicit money, financial information, or any form of financial benefit from other members;
• Transmit unsolicited commercial messages ("spam") or promotional content to other members;
• Attempt to access another member's account without their authorisation;
• Scrape, harvest, or collect data about members through automated means;
• Upload malware, viruses, or any other code designed to interfere with the Platform's functionality;
• Use the Platform for any unlawful purpose or in violation of any local, national, or international law.

Violation of these prohibitions may result in immediate suspension or termination of your account, at our sole discretion, and may be reported to relevant law enforcement authorities.

5. Content and Intellectual Property

5.1 Your Content

By submitting content to the Platform — including photographs, profile text, and messages — you grant Elite Singles a non-exclusive, worldwide, royalty-free licence to use, display, and process that content for the purpose of operating and improving the Platform. You retain ownership of all content you submit.

5.2 Elite Singles Content

All content on the Platform that is not provided by members — including the website design, logo, copywriting, software, and matching algorithm — is the intellectual property of Elite Singles and is protected by applicable copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, or create derivative works from this content without our express written permission.

5.3 Photo Protection

Member photographs cannot be downloaded, reproduced, or shared outside the Platform. Any attempt to circumvent our technical measures protecting member photos is a material breach of these Terms.

6. Safety and Verification

While we manually review profiles and employ fraud detection systems, we cannot guarantee that every member is who they represent themselves to be. You are responsible for exercising reasonable judgement and caution when interacting with other members, particularly before meeting in person. We strongly recommend that your first meeting with any member takes place in a public location.

Elite Singles will never ask you for money, passwords, or financial information. If any person claiming to represent Elite Singles makes such a request, please report it immediately via our contact page.

7. Disclaimers and Limitation of Liability

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free from harmful components.

To the fullest extent permitted by law, Elite Singles shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Platform — including damages arising from interactions with other members outside the Platform.

Nothing in these Terms excludes or limits our liability for fraud, death or personal injury caused by our negligence, or any other liability that cannot be excluded by law.

8. Termination

You may terminate your account at any time through your account settings. We reserve the right to suspend or terminate your account at any time, with or without notice, if we have reason to believe you have violated these Terms or if we are required to do so by law.

Upon termination, your right to access and use the Platform ceases immediately. Certain provisions of these Terms — including intellectual property rights, disclaimers, and limitations of liability — survive termination.

9. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Germany, without regard to its conflict of law provisions. Elite Singles is registered in Berlin, Germany.

Any dispute arising from or relating to these Terms or your use of the Platform shall first be subject to good-faith negotiation between the parties. If negotiation fails, the dispute shall be submitted to the exclusive jurisdiction of the courts of Berlin, Germany, unless you are a consumer residing in a jurisdiction with mandatory local consumer protection rights — in which case those rights are unaffected by this clause.

10. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and notify you by email and in-platform notice at least 14 days before material changes take effect. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms. If you do not accept the revised Terms, you must stop using the Platform and may terminate your account.
